These Terms of Service govern your use of the Noctura online store and purchases made through it. By visiting the store or placing an order, you agree to these Terms, together with the policies linked on the store. If you do not agree, do not use the store or place an order.

1. Store and Eligibility
Noctura operates this online store using Shopify. You must be legally capable of entering into a binding agreement and must provide accurate and complete information when placing an order. You may not use the store for unlawful or unauthorised purposes.

2. Products and Information
We make reasonable efforts to display product descriptions, colours, images, prices and availability accurately. Actual colours may vary by device. We may correct errors or update information and may limit quantities where reasonably necessary. Nothing in these Terms excludes mandatory consumer rights.

3. Prices and Payment
Prices are shown in the currency displayed on the store. Applicable taxes, shipping charges and other costs are presented before you confirm payment. Payment must be made using an available payment method. An order is not accepted until we send an order confirmation or otherwise confirm acceptance.

4. Orders
We may refuse or cancel an order for legitimate reasons, including suspected fraud, pricing or stock errors, payment failure, delivery restrictions or misuse of the store. If we cancel an order after payment, we will refund the relevant amount. You must check that your contact, billing and delivery information is correct.

5. Shipping and Delivery
Processing times, estimated delivery times, shipping charges and tracking information are described in our Shipping Policy. Delivery estimates are not guarantees. Risk passes as provided by applicable consumer law.

6. Cancellations, Returns and Refunds
Cancellation requests, the statutory EU withdrawal right, our 30-day return policy, the 30-Night Sleep Guarantee and refund processing are described in our Refund and Return Policy. Those policies form part of these Terms and do not limit mandatory statutory rights.

7. Legal Guarantee
Consumers benefit from the mandatory legal conformity guarantee provided by applicable law. Commercial guarantees offered by Noctura are additional and do not replace or restrict statutory remedies.

8. Acceptable Use
You may not interfere with the store's security or operation, introduce malicious code, scrape or exploit the service unlawfully, impersonate another person, infringe intellectual-property rights, submit false information, or use the store to violate any law or the rights of others. We may restrict access where reasonably necessary to protect the store, customers or third parties.

9. Intellectual Property
The store's branding, text, graphics, photographs, logos and other content are owned by or licensed to Noctura or its providers and are protected by applicable intellectual-property laws. You may use the store for personal, non-commercial shopping purposes only unless we give written permission.

10. Third-Party Services and Links
Some store functions are provided by Shopify and other third parties. Third-party websites, applications and services may have separate terms and privacy policies. We are not responsible for third-party content or services except where applicable law provides otherwise.

11. Reviews and Feedback
If you submit a review or feedback, it must be honest, lawful and based on genuine experience. You grant us a non-exclusive, worldwide and royalty-free licence to use and display the submitted content for operating and promoting the store, subject to applicable privacy law. We may remove unlawful, misleading, abusive or irrelevant content.

12. Disclaimer and Liability
We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, intentional misconduct, personal injury caused by negligence, or mandatory consumer protections. To the maximum extent permitted by law, we are not responsible for indirect or unforeseeable losses that are not caused by our breach.

13. Privacy
Our handling of personal information is described in the Privacy Policy. Shopify may process information as described in its own privacy materials.

14. Changes
We may update these Terms for legal, regulatory, security or operational reasons. The version applicable to an order is the version made available when that order was placed, unless applicable law requires otherwise.

15. Governing Law
These Terms are governed by Belgian law, without depriving consumers of mandatory protections available under the law of their habitual residence. Any dispute may be brought before a court that has jurisdiction under applicable consumer law.
